Habeas Dockets

Habeas Dockets is a progressive initiative dedicated to enhancing public access to federal habeas corpus case documents that are limited by Federal Rule of Civil Procedure (FRCP) 5.2(c). Recognizing the importance of timely access to legal materials, especially in crucial public cases, the organization aims to eliminate outdated restrictions that hinder accessibility. FRCP 5.2(c) presents challenges for journalists, academics, and the general public, as it restricts remote electronic access to immigration-related case documents.

To address this issue, Habeas Dockets coordinates a network of vetted volunteers who access courthouse public terminals to retrieve these vital documents. Every document is carefully reviewed to ensure authenticity and protect sensitive personal information before being made available online. By leveraging existing legal distinctions, Habeas Dockets provides a practical solution that bridges the gap between legal access and public availability. This project is the flagship of the Immigration Justice Transparency Initiative and seeks to complement existing resources in the pursuit of legal transparency for all.
